Client Training Agreement

1. GUIDELINES, RULES, AND REGULATIONS:

You agree to abide by the attached Iron Oak Dog Company’ Guidelines, and all rules and regulations posted at any Facilities utilized by Iron Oak Dog Company, and the same may be amended from time to time at Iron Oak Dog Company sole discretion. Continued use of the Iron Oak Dog Company Facilities after such amendments equates to an acceptance of those amendments to the Guidelines or the rules and regulations. Any guest who, in the sole determination of Iron Oak Dog Company, violates Iron Oak Dog Company Guidelines, rules or regulations, or is loud, offensive, harasses, is bothersome to other guests, pets, guests or employees or otherwise behaves in an inappropriate or unbecoming manner, may be suspended or terminated by Iron Oak Dog Company.

2. HEALTH WARRANTY:

You represent that you are in good health and have no disability, impairment, injury, disease or ailment, preventing you from engaging in exercise or which could cause increased risk of injury or adverse health consequences as a result of exercise. A physical exam by your physician is recommended before commencing use of the Iron Oak Dog Company Facilities. You also represent that your pet(s) is licensed and current with its rabies, distemper, parvovirus and other vaccinations required by the municipality where your session(s) is conducted and that you will keep the vaccinations current at all times. You understand that providing false information is considered a breach of this Agreement. A physical exam for your pets by your veterinarian is also recommended before commencing use of the Iron Oak Dog Company Facilities.

3. RESPONSIBILITY AND INDEMNIFICATION:

You assume full responsibility for your, your pets’, your dependents’, and your guests’ use of Iron Oak Dog Company Facilities and participation in Iron Oak Dog Company Activities and shall at your own cost defend, indemnify and hold harmless Iron Oak Dog Company, its owners, affiliates, agents and employees, from and against any and all liabilities, claims, causes of action, suits, damages, including without limitation, suits for personal injury, dog bites, or death of third parties, and expenses, including reasonable attorneys’ fees and costs, for which Iron Oak Dog Company becomes liable, or may incur or be compelled to pay by reason of your activities or use of the Iron Oak Dog Company Facilities, Iron Oak Dog Company Activities, or your breach of this Agreement.

4. ACKNOWLEDGEMENT OF RISK:

You, on behalf of yourself, your pet, any dependents and guests, represent that, you understand that use of Iron Oak Dog Company Facilities includes an inherent risk of minor or major life threatening injury to persons, animals, property, and death. You understand that risk of injury to persons and property includes, but is not limited to, injuries arising from or relating to (a) the use by you, your dependent(s), pet(s), guests or others of any and all areas and equipment in the Iron Oak Dog Company Facilities; (b) participation by you, your dependent(s), guests or others in any supervised and unsupervised activities, programs, classes, events on or off Iron Oak Dog Company premises, including any Iron Oak Dog Company Activities, sponsored activities and events; (c) any training, instruction, supervision or dietary recommendations by Iron Oak Dog Company or its staff; (d) medical disorders and injuries that may occur from use of Iron Oak Dog Company Facilities and participating in Iron Oak Dog Company Activities including, but not limited to, minor injuries, severe injuries, traumatic injuries or even death; (e) accidents that may occur anywhere in or around the Iron Oak Dog Company Facilities or while participating in Iron Oak Dog Company Activities or events sponsored by Iron Oak Dog Company or while traveling to or from Iron Oak Dog Company; and (f) theft or loss of property while using Iron Oak Dog Company Facilities. Accidental injuries include those caused by you, an animal or by other persons and those, for example, of a slip and fall or animal bite nature. You, your dependent(s) and guests agree to use due care when using any Iron Oak Dog Company Facilities and/or when participating in any Iron Oak Dog Company Activities and sponsored outside activities and events.

5. ASSUMPTION OF THE RISK:

You hereby freely assume all risks mentioned herein as well as all other risks not listed herein that may be attributed to your use of theIron Oak Dog Company Facilities and Iron Oak Dog Company Activities, and any harm, injury or loss that may occur to you or your property as a result of your participation at the Iron Oak Dog Company Facilities and in the Iron Oak Dog Company Activities - including any injury or loss caused by the negligence of Iron Oak Dog Company, its employees and officers, its contractors, and other guests or participants. You also understand that any equipment that you provide or may borrow or rent from Iron Oak Dog Company or any other provider is at your own risk and that any such equipment is provided without any warranty about its condition or suitability.

6. RELEASE OF LIABILITY:

You hereby release Iron Oak Dog Company, its employees, agents, officers, and contractors, the providers of any equipment used at the Iron Oak Dog Company Facilities and during Iron Oak Dog Company Activities, and their respective employees, officers, and directors (“the Released Parties”) FROM ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS that arise in any way from any injury, death, loss or harm that occurs to you or to any other person or to any property, including animals, during your use of the Iron Oak Dog Company Facilities or in any way related to such, including during transportation to or from. This RELEASE includes claims for the negligence of the Released Parties and claims for strict liability for abnormally dangerous activities. You also agree NOT TO SUE or make a claim against the Released Parties for death, injuries, loss or harm that occur as a result of your use or is in any way related to your use of the Iron Oak Dog Company Facilities.

7. DAMAGE TO PROPERTY:

You understand and agree that Iron Oak Dog Company is not liable for loss, damage or theft of your personal property or that of your guests while in or on Iron Oak Dog Company Facilities. You shall be responsible for any and all damage to any Iron Oak Dog Company Facilities and property caused by you, your pets, your guests or your dependents.

8. INDEPENDENT CONTRACTORS:

From time to time Iron Oak Dog Company will make available to you and your guests the services of independent contractors. Iron Oak Dog Company does not warrant or guarantee the quality of these services and does not guarantee that these services will remain available to you or your guests for any period of time, and hereby disclaims all liability arising out of such services.

9. SEVERABILITY:

If any provision or any part of any provision of this Agreement is held unenforceable, such provision or portion thereof, shall be severed from this Agreement, and such unenforceability shall not affect the other provisions of this Agreement.

10. NOTICES:

Please remember to inform Iron Oak Dog Company of any address or payment changes. Any notice given under this Agreement, shall be considered delivered when mailed to your address or emailed to your email address as listed in the Guest Details of this Agreement or as later changed by written notice to Iron Oak Dog Company. Any notice you send to Iron Oak Dog Company shall be considered delivered only when received by Iron Oak Dog Company.

11. TOOLS OF TRADE AND PRACTICES:

Iron Oak Dog Company uses established tools of trade in its practices and at its facilities to train animals and ensure the safety of its guests and guests. These established tools of the trade include, but are not limited to, leashes, harnesses, training collars, slip collars, prong collars, head halters, remote electronic collars, and electronic pet containment systems. Further, Iron Oak Dog Company also uses established techniques and practices which are described in published books, videos, and professional seminars. Your use of the Iron Oak Dog Company facilities is first conditioned on your acceptance that such tools of trades, techniques and practices are reasonable and humane. As such, you hereby agree that you will not interfere with their use and implementation. You many not share intellectual property provided to you by Iron Oak Dog Company without express written permission.

12. ASSIGNMENT:

Iron Oak Dog Company may assign this Agreement in its sole discretion. You may not assign this Agreement. This Agreement shall be binding upon and inure to the benefit of the parties’ respective successors and assigns.

13. COUNTERPARTS:

This Agreement may be signed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Counterparts may be exchanged by fax or electronic means (e.g., PDF), all of which shall be binding.

14. ENTIRE AGREEMENT:

This Agreement contains the entire agreement of the parties with respect to the subject matter hereof and supersedes any discussions, offers, proposals, agreements or promises with respect thereto. This Agreement may be modified only by a written amendment signed by you and Iron Oak Dog Company.

15. GOVERNING LAW:

This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania. All actions arising under this Agreement shall be exclusively brought in the State of Pennsylvania.

16. ATTORNEYS’ FEES:

If any action, suit, or other proceeding is brought relating to the enforcement or interpretation of this Agreement, the prevailing party shall recover all of such party’s reasonable fees and expenses, including attorneys’ fees and expenses incurred in connection with such action. This section shall not be deemed to provide for the award of attorneys’ fees for personal injury, or non-contractual claims.

17. PAYMENT AND REFUNDS:

All fees must be paid in full prior to service being delivered. Fees paid for services are refundable at the sole discretion of Iron Oak Dog Company. Services not completed by the stated expiration date will be considered forfeited.

18. MEDIA RELEASE:

You hereby assign and grant to Iron Oak Dog Company the right and permission to use, reproduce, distribute, and publish the photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) made of you and/or your dog(s) at any time during the training and/or boarding of your dog(s) by Iron Oak Dog Company, and you hereby release Iron Oak Dog Company from any and all liability resulting from such use, reproduction, distribution, and publication.

You hereby authorize the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) without limitation at the discretion of Iron Oak Dog Company and you specifically waive any right to any compensation you may have for any of the foregoing.

19. FORCE MAJEURE EVENTS:

Iron Oak Dog Company shall not be considered in breach of this agreement due to any failure to perform its obligations under this Agreement as a result of a cause beyond its control, including any act of god or a public enemy or terrorist, act of any military, civil or regulatory authority, change in any law or regulation, fire, flood, earthquake, storm or other like event, disruption or outage of communications, power or other utility, labor problem, unavailability of supplies, or any other cause, whether similar or dissimilar to any of the foregoing, which could not have been prevented by such party with reasonable care (each, a "Force Majeure Event"). If such an event occurs, Iron Oak Dog Company will make reasonable efforts to resume lesson delivery on the same schedule as soon as possible. 

20. GUARANTEE:

Iron Oak Dog Company offers no guarantee of results outside of those stated explicitly in the summary of services for your training program. You could have more or less success based on the amount of time and effort you put into working with your dog, your ability to grasp and implement training concepts and techniques, your dog's unique genetics, the environments in which you place your dog, and a variety of other factors. Any guarantee explicitly stated on the invoice for your training program is subject to the following terms and conditions:

  • You must successfully complete all lessons and homework assignments included in your training program.

  • You must use the tools and techniques requested by Iron Oak Dog Company.

  • This offer is void if you engage in any dog training or behavioral intervention services with another provider after engaging the services of Iron Oak Dog Company.

  • This offer is void if you receive a full or partial refund for services rendered under this agreement.

21: LIFETIME SUPPORT:

Iron Oak Dog Company will, at its sole discretion, offer continued training support for the lifetime of the dog participating in the training services subject to this agreement, only when explicitly mentioned in the summary of services on your invoice. This offer is subject to the following terms and conditions:

  • The format of that support may be any service offered by Iron Oak Dog Company at the time you submit a request for support, and is determined at the sole discretion of Iron Oak Dog Company.

  • The time and location of any service will be determined at the sole discretion of Iron Oak Dog Company.

  • This offer is contingent on Iron Oak Dog Company’s continued recognition as a legitimate business entity in good standing in the State of Pennsylvania.

  • This offer is void if you engage in any dog training or behavioral intervention services with another provider after engaging the services of Iron Oak Dog Company.

  • This offer is void if you receive a full or partial refund for services rendered under this agreement.

22: GUIDELINES as of January 1, 2026

  • It is generally expected that any dog is kept on leash (no more than 6 feet in length) at all times, and in positive control of the owner handler except when directed by Iron Oak Dog Company.

  • All visitors (customer or not) are expected to be courteous and aware of their surroundings, particularly when in proximity to any pet or animal, regardless of it being on leash.

  • Failure to comply with written, posted, or verbal communication/directives from Iron Oak Dog Company staff may result in immediate expulsion from the premises for both owner and pet, and may result in suspension of membership without refund of money or fees already paid to Iron Oak Dog Company

  •  It is the responsibility of adults with children to see to it that their children are well-behaved and supervised. Children age 17 and under must be accompanied by an adult while attending Iron Oak Dog Company events. No children under the age of 10 may attend training sessions unless that session is held at your home.

  • There is an absolute, zero-tolerance policy for any unwanted approach towards someone else’s pet or dog without verbal permission from the owner to do so. Any taunting, teasing, agitation towards any pet or dog will result in an immediate 30-day suspension without refund and may be subject to further penalties (financial and otherwise).

  • Any mistreatment (verbal, physical, neglect, or otherwise) of any animal deemed inappropriate by Iron Oak Dog Company staff and management may result in suspension, termination of membership or other paid fees without refund, and may also result in the involvement of animal control/law enforcement agencies (where necessary).

  • The filming of training or other Iron Oak Dog Company sponsored events and activities, is allowed only by first obtaining written permission from Iron Oak Dog Company staff/employees, or management. Failure to obtain proper permission to film any aspect of activity or business being conducted at Iron Oak Dog Company may result in penalty and membership suspension or termination without refund.

  • Alcohol and drugs are strictly prohibited from the premises. Anyone found to be caught under the influence of drugs or alcohol, or in possession of the same, will be immediately asked to leave the premises, with a possible notification to local law enforcement, and an immediate 90-day suspension of all membership access will take place and may result in permanent termination of any opportunity to participate at Iron Oak Dog Company going forward.

  • Lost or stolen items are not the responsibility of Iron Oak Dog Company, and it is up to each person to adequately secure personal belongings.

  • The use of closed circuit, or other recording devices, may/will be used by Iron Oak Dog Company’s and its representatives for safety, training, and capturing special events held by Iron Oak Dog Company, and customers/visitors agree to being recorded for these purposes.
